TERMS OF SERVICE AGREEMENT

Welcome to AnthonyMueller.com (“Website”). This Terms of Service Agreement (“Agreement”), defined by its Use & Licensing, governs your access to and use of the Website, including all wine reviews, scores, and related content (“Content”). By accessing or using this Website, you agree that you are of drinking age in the country that you are accessing this website from, and you comply with and be bound by this Agreement.
- Copyright and Intellectual Property
All Content on this Website, including the Wine Database, but not limited to wine reviews, scores, tasting notes, and articles, is the exclusive property of Anthony Mueller Consulting LLC (“Owner”) and is protected by copyright law. Unauthorized use, reproduction, or distribution of any Content without prior written consent is strictly prohibited.
Wineries that pay the required licensing fee are granted limited republishing rights as outlined in Section 3.
- Submitting Wines for Review
- Wineries may submit wines for review at no cost.
- Reviews and scores are conducted independently and impartially.
- Submission of a wine does not guarantee a positive review or a minimum score.
- For any international wines submitted for review, the Owner does not assist with COLA waiver forms.
- Republishing Rights and Licensing
- Wineries that wish to republish reviews and scores of their submitted wines must pay a licensing fee of $25 per wine, plus tax.
- The maximum amount a winery will pay is capped at $250, plus tax, for a calendar year, with any additional wines beginning at 11 or more being reviewed for free, upon the Owner’s discretion.
- Once paid, the winery, along with the winery’s importers, exporters, distributors and public relations firms, receives a non-exclusive, non-transferable, perpetual license to republish the specified wine review and score.
- Republishing rights are non-transferable beyond the winery and its designated importers, exporters, distributors and PR firms.
- Wineries must attribute the review and score to “AnthonyMueller.com” and Anthony Mueller as the reviewer.
- New vintages require a separate submission and licensing fee.
- All billing and electronic invoicing for republishing rights will be issued by Anthony Mueller Consulting LLC.
- Permitted Uses and Restrictions
Permitted Uses:
- Website and online store listings.
- Social media marketing.
- Printed price sheets and promotional materials.
- Winery tasting rooms and direct-to-consumer sales materials.
- Any other marketing materials directly related to the sale of the reviewed wines.
Restrictions:
- Licensee may not alter, modify, or misrepresent the content of the review or score.
- Licensee may not sublicense or transfer the rights to any third party outside of the winery’s importers, exporters, distributors or PR firms.
- Republishing rights do not imply endorsement or partnership between Licensor and Licensee.
- Unauthorized Republishing and Consequences
- Wineries may not republish reviews or scores without payment.
- Unauthorized republishing constitutes copyright infringement and may result in:
- A Cease & Desist order
- Fines or legal action
- Exclusion from submitting future wines for review
- If a winery is found to be using unauthorized Content, the Owner reserves the right to demand immediate removal and pursue legal remedies.
- Payment Terms and Refund Policy
- Payments for republishing rights are final and non-refundable.
- Wineries will receive an electronic invoice with multiple payment options from Anthony Mueller Consulting LLC.
- Failure to complete payment means the winery does not have the right to republish reviews and scores.
- Attribution and Brand Use Restrictions
- Wineries may not modify or misrepresent reviews or scores.
- Republishing rights do not imply endorsement or partnership with the Owner.
- Wineries are strictly prohibited from using the Owner’s name or brand in misleading promotional materials.
- Copyright Enforcement and DMCA Compliance
- The Owner actively monitors for unauthorized use of Content.
- If unauthorized Content is found online, a Digital Millennium Copyright Act (DMCA) takedown notice may be issued.
- Third parties who infringe on these rights may be subject to legal action.
- Disclaimer of Warranties
- All reviews and scores are the personal and professional opinions of the Owner.
- The Owner makes no guarantees regarding how a review or score may impact a winery’s sales or reputation.
- Limitation of Liability
- The Owner shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the Website or Content.
- Governing Law and Dispute Resolution
- This Agreement shall be governed by and interpreted under the laws of California, United States.
- Any disputes arising under this Agreement shall be resolved through binding arbitration in Napa County, California.
- Updates to this Agreement
- The Owner reserves the right to update this Agreement at any time. Continued use of the Website constitutes acceptance of the modified terms.
